Where these matters are filed, and for whom
Jurisdiction in a matrimonial case usually follows where the marriage was solemnised, where the parties last resided together, or where the respondent resides. For most people living in Gurgaon district, that means the Family Court at Gurgaon.
Gurgaon district
Consultations are held at the chambers in Gurgaon and matters are filed before the Family Court, the Court of the Judicial Magistrate and the District & Sessions Court here. Residents across the district are served, including DLF Phases 1 to 5, Golf Course Road and Golf Course Extension Road, Sohna Road, Sushant Lok, South City, Palam Vihar, Sector 56 and the sectors along Dwarka Expressway, New Gurgaon, Manesar, Badshahpur, Sohna, Pataudi and Farrukhnagar.
Beyond Gurgaon
- Faridabad, Rewari, Jhajjar and Nuh — where jurisdiction lies in a neighbouring district of Haryana.
- Delhi — where the marriage was solemnised in Delhi or the parties last resided together there, matters are filed before the appropriate District Court.
- Chandigarh — appeals from the Family Court, quashing petitions and protection petitions before the Punjab & Haryana High Court.
- Elsewhere in India, and abroad — transfer petitions before the Supreme Court, and matters where one party lives outside India. See NRI and cross-border matters.
Where you live is not always where you file. Living in Gurgaon does not by itself give the Family Court here jurisdiction, and living elsewhere does not prevent it. The question is where the marriage was solemnised, where you last resided together, and where the respondent is. Where more than one court is competent, the choice between them is a strategic decision.
